Copyright Infringement Claims

  • Identification of the Infringing Material: A description of the material that you claim is infringing and that you want removed or access to which you want disabled, along with the specific URL or other location on our Website where the material that you claim is infringing is located. Your description must be reasonably sufficient to permit us to locate the material.
  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
  • Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Signature: A physical or electronic signature (full legal name) of the copyright owner or a person authorized to act on their behalf.

How to Submit a DMCA Notice

We will review your notice and respond as promptly as possible, typically within five (5) to ten (10) business days of receiving a complete and valid notification.

Counter-Notification

If you believe that material you posted on our Website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, your counter-notification must be a written communication that includes the following:

  • Identification of the Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (including the specific URL).
  • Statement Under Penalty of Perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Signature: Your physical or electronic signature (full legal name).

How to Submit a Counter-Notification

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the original complainant does not file a court action against you within ten (10) to fourteen (14) business days of receiving the counter-notification, we may restore the removed material at our discretion.

Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Website or terminate the availability of any content posted by users who infringe the intellectual property rights of others, regardless of whether there is any repeat infringement.

Our repeat infringer policy includes the following measures:

  • Tracking DMCA notices received against specific content or users.
  • Removing content that is subject to multiple valid DMCA takedown notices.
  • Taking additional appropriate action against repeat infringers as determined necessary.
